- Purpose of the Rules
The purpose of this Policy is to set out the rules for the use and storage (data management) of the data provided during the purchase and registration on the Körpince Ltd. webshop (www.mokos.hu, hereinafter referred to as the "Website") in accordance with the provisions of Act CXII of 2011 on Freedom of Information and the European Union's General Data Protection Regulation on the protection and processing of personal data ("GDPR").
- Definitions
- Data subject: any specific natural person who is identified or identifiable, directly or indirectly, on the basis of personal data;
- Personal data: data which can be associated with the data subject, in particular the name, the identification mark and one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity, and the inference which can be drawn from the data concerning the data subject;
- Data processing: any operation or set of operations which is performed upon data, regardless of the procedure used, in particular collection, recording, recording, organisation, storage, alteration, use, consultation, disclosure, transmission, alignment or combination, blocking, erasure and destruction, as well as the prevention of further use of data;
- Data Controller: Körpince Kft. (registered office: 7771 Palkonya, Hegyalja u. 1.);
- Data processing: the performance of technical tasks related to data processing operations, irrespective of the method and means used to perform the operations and the place of application, provided that the technical task is performed on the data;
- Transfer: making data available to a specified third party;
- Disclosure: making the data available to anyone;
- Consent: a voluntary and explicit expression of the data subject's wishes, based on appropriate information, by which he or she gives his or her unambiguous consent to the processing of all or some of the personal data relating to him or her;
- Data processor: a natural or legal person or unincorporated body which processes data on the basis of a contract with the controller, including a contract concluded pursuant to a legal provision;
- Data erasure: the rendering of data unrecognisable in such a way that it cannot be recovered.
- Scope of personal data processed
3.1 The following data may be provided at the user's choice: e-mail address, telephone number, name, place of residence/residence, place and date of birth.
3.2.Data technically recorded during the operation of the system: the data of the user's computer logging in, which are generated during the use of the service and which are recorded by the data controller's system as an automatic result of technical processes. The data that are automatically recorded are automatically logged by the system at the time of logging in or logging out, without any specific declaration or action by the user. These data may not be linked to other personal user data, except in cases required by law. The data may only be accessed by the data controller.
- Legal basis, purposes and methods of processing
4.1 The legal basis for processing is the consent of the data subject. The processing is carried out because the users of the content on the website have given their express consent voluntarily and on the basis of appropriate information. The legal basis for data processing is Article 5 (1) a) of Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information.
4.2 The purpose of the processing is to ensure the provision of the services available under the URL of the website. The scope of the personal data to be provided for the use of these services is set out in the description of the relevant services.
4.3 The purpose of the automatically recorded data is to produce statistics, to improve the technical development of the IT system and to protect the rights of users.
4.4 The controller may not use the personal data provided for purposes other than those described in these points. The disclosure of personal data to third parties or public authorities, unless otherwise required by law, shall only be possible with the prior explicit consent of the user.
4.5 The Controller does not verify the personal data provided to it. The person providing the data is solely responsible for the accuracy of the data. Any user who provides an e-mail address is also responsible for the fact that he/she is the only one to use the service from the e-mail address provided. In view of this responsibility, any liability for accessing the service from an e-mail address is borne solely by the user who registered the e-mail address.
- Principles of data management
Data should only be obtained and processed fairly and lawfully. Data must be stored only for specified and lawful purposes and must not be used in any other way. The data must be proportionate to, and compatible with, the purpose for which it is stored and may not go beyond that purpose. The data must be stored in a way which permits identification of the data subject only for the time necessary for the purpose for which the data are stored. Appropriate security measures should be taken to protect personal data stored in automated data files against accidental or unlawful destruction or accidental loss, and against unlawful access, alteration or dissemination.
- Privacy policy applied by the website
6.1 Körpince Ltd. uses personal data that are indispensable for the use of its services on the basis of the consent of the data subjects and only for the purposes for which they are intended.
6.2 The website, as the data controller, undertakes to process the data in its possession in accordance with the Data Protection Act and the data protection principles set out in this Policy and not to transfer them to third parties. An exception to this is the use of data in aggregated statistical form, which may not contain the name of the user concerned or any other form of identifiable data.
6.3 In certain cases, the website may make available to third parties the data available to the user concerned in the event of a formal judicial or police request, legal proceedings for infringement or reasonable suspicion of infringement of copyright, property rights or other rights, or for the purpose of damaging the interests of the website, endangering the provision of its services, etc.
6.4 The Ltd.'s system may collect data about the activity of users, which cannot be linked to other data provided by users at the time of registration, nor to data generated by the use of other websites or services.
6.5 The website undertakes to publish a clear, prominent and unambiguous notice informing users of the method, purpose and principles of data collection before any data of its users are collected, recorded or processed. In addition, in all cases where the collection, processing or recording of data is not required by law, the website will draw the user's attention to the voluntary nature of the data provision. In the case of compulsory data provision, the legal provision imposing the data processing shall also be indicated. The data subject shall be informed of the purposes of the processing and of the persons who will process the data. The information on the processing shall also be provided where the law provides for the inclusion of data by transfer or linking from existing processing.
6.6 In all cases where the website intends to use the data provided for purposes other than those for which they were originally collected, it will inform the user and obtain his/her prior express consent or give him/her the opportunity to prohibit such use.
6.7 Körpince Kft. as the data controller shall in any case comply with the restrictions laid down by law in the collection, recording and processing of data, and shall inform the data subject of its activities by electronic mail as requested. The website undertakes not to impose any sanctions on users who refuse to provide non-compulsory data.
6.8 Körpince Ltd. undertakes to ensure the security of the data, to take technical and organisational measures and to establish procedural rules to ensure that the data recorded, stored or processed are protected and to prevent their destruction, unauthorised use or unauthorised alteration. It also undertakes to require any third party to whom it may transfer or disclose the data to fulfil its obligations in this respect.
- Duration of processing
7.1 The processing of personal data provided by the user will continue until the user unsubscribes from the service with the given user name. The date of deletion is 10 working days from the date of receipt of the user's unsubscription (request for deletion). In the event of unlawful or fraudulent use of personal data or in the event of a criminal offence or system attack committed by the user, the Data Controller is entitled to delete the data immediately upon termination of the user's registration, but in the event of suspicion of criminal offence or civil liability, the Data Controller is also entitled to retain the data for the duration of the proceedings to be conducted.
7.2 The personal data provided by the user, even if the user does not unsubscribe from the service, may be processed by the website as data controller until the user explicitly requests in writing that the processing of such data be terminated. The user's right to use the service is not affected by his/her request to cease processing without unsubscribing from the service, but he/she may not be able to use certain services without personal data. Data will be deleted within 10 working days of receipt of the request.
7.3 Data that are automatically and technically recorded during the operation of the system are stored in the system for a period of time from the moment they are generated that is reasonable for the operation of the system. The website ensures that these automatically recorded data cannot be linked to other personal user data, except in cases required by law. If the user has withdrawn his/her consent to the processing of his/her personal data or has unsubscribed from the service, his/her identity will no longer be identifiable from the technical data.
- Processing of personal data
8.1 A change in personal data or a request for the deletion of personal data may be communicated by means of an express written statement sent by letter through the internal mail system of the service. The sending of newsletters can be cancelled by changing the settings of the user interface on the site.
8.2 In addition, certain personal data may be changed by editing the personal profile page.
8.3 Once a request for deletion or modification of personal data has been fulfilled, the previous (deleted) data can no longer be restored.
- Data processing
Körpince Ltd. does not use a separate external data processor. It processes the personal data it processes itself.
- Possibility of data transfer
10.1 The website, as the data controller, is entitled and obliged to transmit to the competent authorities any personal data available to it and stored by it in accordance with the law, which it is obliged to transmit by law or by a final and binding obligation of a public authority. The data controller shall not be held liable for such transfers and the consequences thereof.
10.2 If the operation or use of the content service on the mokos.hu website is transferred in whole or in part to a third party, the data processed by the website may be transferred to such third party for further processing without any further consent being required. This transfer may only serve to ensure the continuity of the registration of users who have already registered, but may not place the user in a less favourable position than the data processing and data security rules set out in the current version of this Privacy Policy.
- Amendments to the Privacy Policy
Körpince Ltd reserves the right to amend this Privacy Policy at any time by unilateral decision. Following the modification of the Privacy Policy, all users shall be informed in an appropriate manner (newsletter, login pop-up). By continuing to use the service, users acknowledge the changed Privacy Policy and no further consent is required.
- Rights of users in relation to their personal data processed by the controller
12.1 Users may request information about the processing of their personal data from the website as the data controller at any time in writing, by registered or certified mail sent to the address of the data controller or by e-mail sent to the e-mail address on the contact page of the website. Requests for information sent by e-mail shall be considered as authentic by the controller only if they are sent from the registered e-mail address of the user. The request for information may cover the data of the user processed by the controller, the purpose, legal basis and duration of the processing, the names and addresses of any data processors, the activities related to the processing, as well as who has received or is receiving the user's data and for what purposes.
12.2 The data controller shall respond to any query regarding the processing within 8 working days of receipt. In the case of e-mail, the date of receipt shall be deemed to be the first working day following the date of sending.
- Enforcement options
The possibilities of enforcing the user's rights are described in detail in the Act on the Right to Informational Self-Determination and Freedom of Information (Act CXII of 2011), and Act IV of 1959 (Civil Code), and may also seek the assistance of the Commissioner for Fundamental Rights (1051 Budapest, Nádor u. 22., postal address: 1387 Bp. Pf.: 40.) or the National Authority for Data Protection and Freedom of Information (1125 Budapest Szilágyi Erzsébet fasor 22/c, 1530 Budapest, Pf.: 5.) in any matter concerning personal data. Any questions or comments regarding data processing can also be addressed to the staff of the data controller at the e-mail address on the contact page of the website.
